Saudi New Absent From Work Law Updated
The employment contract system has been updated by the Qiwa platform, which affects how employers can report employees as “absent from work,” and this new Absent From Work Law will ease foreigners lives in the kingdom.
The platform states that an employer may only make such a request if the employee has no active employment contracts at the time of the request and their residency permit (Iqama) is valid for at least 60 days.
When an employee’s status is changed to “disconnected from work,” they have sixty days to decide whether to re-contract with the same company, leave the Kingdom, or transfer to another employer.
The employee will be automatically marked as “absent from work” and deleted from the company’s records if nothing is done within this time frame.
According to the updated system, a work contract will be marked as “terminated” if the notice period expires, whether due to a decision by the employer or the employee, and the contractual relationship comes to an end.
The appropriate authorities at the Ministry of Human Resources and Social Development (MHRSD) and the Ministry of Interior will be automatically notified if the employee does not take further action during the grace period.
The ministry previously explained that through the “Qiwa Individuals” account, Qiwa allows employees to receive free salary definition certificates.
The certificate will display the worker’s most recent employment details if they are currently employed. Employees who have prior experience can ask for a service certificate attesting to their prior positions.
Employees can use this feature by logging into their Qiwa Individuals account, going to services, choosing “Employment Certificates,” and then following the instructions to create a certificate of service or a salary certificate.
By formally documenting professional experience, the platform also helps improve resumes and boost job competitiveness.
